Windfall Tax Cut Aids DTA Fuel Exporters, Not Drivers
India cut export windfall tax on petrol, diesel and ATF from September 16, a DTA-only relief that leaves pump duties and Jamnagar’s SEZ refinery unchanged.
India cut the windfall tax on petrol, diesel and ATF exports from September 16, taking the diesel levy to Rs 20 a litre from Rs 25. ATF fell to Rs 15 from Rs 19, and petrol to Rs 0.5 from Rs 1.5. Duties on fuel sold at Indian pumps did not change.
The order lowers the bill for exporters in the domestic tariff area. Reliance Industries’ 35.2-million-tonne Jamnagar SEZ unit, built to ship fuel abroad, was already outside the tax.
Export Duties Fall on Diesel, ATF and Petrol
Finance Ministry orders dated September 16 trimmed special additional excise duty on the three fuels and took the Re-denominated road cess off diesel exports. The previous pack, in force from September 1, had set diesel at Rs 25 a litre, made of Rs 24 of SAED and Rs 1 of Road and Infrastructure Cess. The new pack is Rs 20 of SAED and no cess.
EXPORT LEVIES FROM SEPTEMBER 16
| Fuel | From September 1 | From September 16 | Change |
|---|---|---|---|
| Diesel | Rs 25 (SAED Rs 24 + cess Rs 1) | Rs 20 (SAED Rs 20, cess nil) | Rs 5 down |
| ATF | Rs 19 | Rs 15 | Rs 4 down |
| Petrol | Rs 1.5 | Rs 0.5 | Rs 1 down |
That is a Rs 5 break on diesel, Rs 4 on jet fuel, and Rs 1 on petrol, for the fortnight that began September 16. The ministry said the rates track average international prices of crude, petrol, diesel and ATF since the last review. It also said excise on petrol and diesel sold at home is unchanged, so the pump board is not part of this order.
Jamnagar’s Export Refinery Never Paid the Tax
Reliance runs two plants at Jamnagar in Gujarat. The domestic-tariff refinery is rated at 33 million tonnes a year, and the SEZ unit is rated at 35.2 million tonnes a year and is meant only for export. When the levy came back in late March, a revenue department official put the SEZ unit outside it.
As per judicial pronouncements on this issue, the special additional excise duty (SAED) and additional excise duty (AED) are not applicable on SEZ refineries.
Jainendra Singh Kandhari, Joint Secretary, Tax Research Unit, Department of Revenue
Citi Research, looking at FY25, put 75% of Reliance diesel output and 35% of its jet fuel at the SEZ plant. Those barrels never entered this tax. The September cut therefore lands on DTA cargoes: Reliance’s other Jamnagar unit, Nayara Energy, the state refiners, and smaller standalone plants.
The legal split is old. Goods leaving an SEZ are treated as exports from a zone the SEZ Act keeps apart from the domestic tariff area, which is why the 2022 windfall cycle used the same carve-out. The biggest export machine in the country is still on that side of the line.
What India’s Fuel Export Numbers Show
India still ships a large slice of its refinery output. Figures for diesel, petrol and ATF export volumes from the Petroleum Planning and Analysis Cell show product exports at 22.9% of POL output in June 2026, and 10.8% of the country’s gross exports that month. Diesel is the heavy line.
PPAC PRODUCT EXPORTS, THOUSAND TONNES
| Product | June 2026 | July 2026 |
|---|---|---|
| HSD (diesel) | 1,339 | 2,438 |
| MS (petrol) | 974 | 1,283 |
| ATF | 414 | 439 |
The April petroleum import-export table lists HSD shipments at 1,627 thousand tonnes, with petrol at 887 and ATF at 426. July diesel exports jumped to 2,438 thousand tonnes from 1,339 thousand in June. PPAC marks the series as provisional.
JUNE 2026 EXPORT SHARE
- Of POL output: Petroleum exports were 22.9% of Indian POL production.
- Of total exports: The same shipments were 10.8% of India’s gross exports.
- Diesel’s weight: HSD remains the largest of the three taxed product lines in the PPAC table.
A cut of Rs 5 a litre on diesel is the line that moves money, because that is the barrel India actually ships in size. Petrol’s levy was already a thin Rs 1.5. ATF volumes are smaller than diesel, though the duty on jet fuel is still steep at Rs 15.
The March Deal Left Pump Duties Untouched
The export levy is a 2026 reboot, not a new idea. India first put a windfall tax on fuel exports in July 2022 after the Russia-Ukraine shock, then took it off in December 2024. It came back through the March 26 Central Excise notifications, with diesel at Rs 21.5 a litre and ATF at Rs 29.5. Petrol was added from May 16.
The same March package cut central excise on petrol and diesel sold at home by Rs 10 a litre. That was the consumer-facing move. The export duty was the offset, meant to keep barrels in the country while West Asia disrupted trade.
THE MARCH 2026 FISCAL SWAP
- Export take: CBIC Chairman Vivek Chaturvedi put the new levies at about Rs 1,500 crore a fortnight.
- Pump giveaway: Internal estimates put the Rs 10 excise cut at about Rs 7,000 crore of lost duty over the same two weeks.
- Barrel math: Citi Research put the March diesel levy at about $36 a barrel and the jet levy at about $50.
- OMC squeeze then: The petroleum ministry put PSU under-recoveries at Rs 24.40 a litre on petrol, Rs 104.99 on diesel, and Rs 380 a cylinder on LPG, with only an 8.6% ATF hike passed to domestic airlines.
Those under-recovery figures belong to that March week, when crude had been above $100 a barrel. They are not this fortnight’s pump math. They show why the Centre split the tools: a home-duty cut for the board, an export duty for the cargo.
At a time when international diesel prices have surged sharply, the levy is designed to disincentivise exports and ensure that refinery output is directed first towards meeting domestic demand. Keeping Indian pumps fully supplied takes precedence over export opportunities, however commercially attractive those may be at current global prices.

The September 1 Hike Lasted Two Weeks
The ministry revises the rates every fortnight on those average international prices. The September 1 pack had raised diesel to Rs 25, petrol to Rs 1.5, and ATF to Rs 19, and it had put Rs 1 of road cess back on diesel exports. The September 16 pack reversed that step.
THE WINDFALL TAX CYCLE SINCE 2022
- July 2022: India first levies a windfall tax on fuel exports after the Russia-Ukraine oil shock.
- December 2024: The levy is withdrawn.
- March 26, 2026: SAED returns on diesel at Rs 21.5 a litre and on ATF at Rs 29.5, with a Rs 10 cut in home excise the same week.
- May 16, 2026: Petrol exports are brought into the levy.
- September 1, 2026: Diesel is raised to Rs 25 a litre, petrol to Rs 1.5, and ATF to Rs 19, and Rs 1 of cess is added on diesel.
- September 16, 2026: Diesel falls to Rs 20, ATF to Rs 15, and petrol to Rs 0.5, and the diesel cess is taken off.
The machine is a thermometer. When cracks widen, the duty goes up. When they cool, it comes down. The September 16 sheet is the cooling print, two weeks after the last hike.
DTA Refiners Collect the Extra Rupees
The rupees that come off the levy accrue to whoever actually pays it. That is the DTA list, not the SEZ unit, and not the motorist.
DTA REFINERS INSIDE THE TAX NET
- Reliance DTA: The 33-million-tonne Jamnagar unit still pays SAED on eligible exports; the 35.2-million-tonne SEZ unit does not.
- Nayara Energy: A large private DTA exporter in the same net as other non-SEZ plants.
- PSU refiners: Indian Oil, Bharat Petroleum, and Hindustan Petroleum pay on DTA export cargoes they still put on the water.
- Other standalones: Nomura in April named MRPL, CPCL, HPCL Mittal Energy, and Numaligarh among plants in the DTA net.
Nomura’s April note argued that a high export duty can help the oil marketing companies, because standalone plants may then sell diesel at home at the weaker post-tax export net. The note said HPCL sources 40% of its diesel retail sales from standalone refiners. A cut works the other way: DTA exporters keep more of the export barrel, and the incentive to divert that barrel into the OMC system gets weaker, not stronger.
The louder objection is simpler. This order does not move petrol or diesel at the pump, because home excise did not move. Reading it as cheap fuel is a category error. It is a two-week change in the price of sending DTA barrels abroad, with the largest export plant in Jamnagar still off the sheet.
The next review is due for the fortnight beginning September 30, on the same price rule. The SEZ unit in Jamnagar will still be outside it.
Frequently Asked Questions
Does the Windfall Tax Cut Lower Petrol Prices in India?
No. The September 16 cut applies to exports, and the Finance Ministry left home excise on petrol and diesel unchanged. The pump price also carries state VAT and dealer commission, which this order does not touch. The consumer-facing central tool in this cycle was the March cut of Rs 10 a litre in home excise, not this fortnight’s export sheet.
Do SEZ Refineries Pay India’s Fuel Export Windfall Tax?
No. The Special Economic Zones Act, 2005 keeps SEZs outside the domestic tariff area, and the Department of Revenue has said SAED and additional excise duty do not apply to SEZ refineries. The same carve-out was used in the 2022 windfall cycle. Reliance’s 35.2-million-tonne Jamnagar SEZ unit is the live case.
When Did India Reimpose the Windfall Tax on Fuel Exports?
The 2026 cycle began with Central Excise orders dated March 26, putting diesel at Rs 21.5 a litre and ATF at Rs 29.5. Petrol was added from May 16, 2026. The first Indian fuel-export windfall tax was imposed in July 2022 and withdrawn in December 2024.
How Often Does India Revise the Fuel Export Windfall Tax?
Every fortnight, using average international prices of crude oil, petrol, diesel, and ATF since the last review. SAED and Road and Infrastructure Cess can be moved on separate tracks. This round cut SAED on diesel to Rs 20 a litre and took the Rs 1 cess off entirely.
